Despite the arrest of a car loaded with ganja and its driver 180 days ago, the police have yet to file a charge sheet. Consequently, the accused driver was released on bail. Frustrated by the Churaibari police's delay in filing charge sheets in severe drug trafficking cases, Hon'ble Justice Arindam Lodh of the High Court of Tripura instructed the DGP to take legal action against the responsible investigating officer.
Sources said that Justice Lodh summoned the investigating officer to court on Thursday, questioning the reason for the delay in filing chargesheets in serious offences such as ganja smuggling.
The special NDPS court in Darmanagar granted the bail to the ganja smugglers on July 22.
Following the officer's explanation, Justice Arindam Lodh, the High Court judge allowed the withdrawal of the bail petition for accused Mohidul Islam, filed by senior lawyer Subrata Sarkar, since the special NDPS court had already granted the accused bail.
For several years, numerous arrests have been made at Tripura's Churaibari Gate related to ganja and other drug smuggling cases. Despite the significant seizures, no criminals have been convicted. Allegations have surfaced that police are negotiating the release of these traffickers.
Justice Arindam Lodh stated in his judgment, "In this case, the accused received default bail due to the failure to furnish a charge sheet within 180 days. The accused was arrested for a serious offence under the NDPS Act. The investigating officer must act with vigilance and diligence. There is reasonable ground to believe that the officer was negligent in submitting the charge sheet on time. Necessary action should be taken against the investigating officer to prevent such negligence in the future. The application is allowed to be withdrawn and disposed of as withdrawn. A copy of this order will be sent to the Superintendent of Police of the concerned district and the DGP, Government of Tripura." (Source: Tripurainfo)
