The Tripura Electricity Regulatory Commission (TERC) is one of the few regulators in India that has provided compensation for electric accidents.
In a big step forward the TERC laid down precise regulations promoting public safety and providing prompt assistance to electrocution victims.
The concerned authority failing to meet the mandated standards of performance shall be liable to pay compensation as specified in the concerned Regulations to persons affected for the loss of human or animal life or injury to human beings, animals or property in consequence of an electrical accident.
“Whether or not there has been any wrongful net, omission, rashness, neglect or default on the part of the licensee and generating companies as We case way be as would entitle the person affected to maintain a civil action for recovery of any damages or compensation or maintain a prosecution for invoking criminal liability”, the TERC regulations mentioned.
The licensee-generating companies shall not be held liable to pay compensation under these Regulations if the loss of human life is due to suicide or homicide, or if injury to a human being is caused by an attempt to commit suicide or homicide.
