Apr 05, 2017: Steps will be initiated to protect the interests of the terminated teachers in conformity with the Apex Court verdict, said Chief Minister Manik Sarkar today. He said that the government will write to HRD Ministry to provide age relaxation in eligibility criteria for Teachers’ Eligibility Test (TET) for those teachers who are going to be terminated from their posts on the 31st of December this year as per the recent order of the Supreme Court.
The State Government today reaffirmed its decision to stand by the side of 10323 terminated teachers and after the Apex Court verdict on March 29, the Chief Minister Manik Sarkar, at last, made a formal statement on teachers’ termination case today.
Chief Minister Manik Sarkar today stated ‘the judgment was unexpected’. However, he reiterated Government will stand by the side of those 10323 teachers who have been terminated in compliance of Apex Court verdict.
Addressing a press conference today at Secretariat, Manik Sarkar stated, the Council of Ministers today examined in details the March 29 verdict of the Supreme Court which dismissed Special Leave Petition filed on behalf of the State Government. Discussions were also held on the directives that the Apex Court issued.
It is stated in press release, the State Government is concerned with the future of all the teachers affected by the Court’s order and reaffirms that all possible steps shall be taken to protect the interest of the affected teachers who have already served the State with their sincerity and dedication”.
If not already framed, “new recruitment policy will be framed by April 30, 2017 in conformity with the directives of the Supreme Court”, Sarkar said and added advertisements inviting applications for vacancies may be issued latest by May 31, 2017.
A press release mentioned, “The State Government is committed to ensure that ongoing educational endeavours and smooth functioning of the educational institutions are disrupted and the future of the children”.
As far as the directives of the Apex Court are concerned, it is stated in a press release of the State Government, New Employment Policy shall be framed by the State by April 30, 2017 if not already frames. Advertisement for filling up the vacancies may be issued latest by May 31, 2017. The fresh selection process be completed on or before December 31, 2017 and till the fresh process is completed, teachers already appointed shall continue.
Court directives also mentioned, the candidates who participated in the selection process pursuant to the advertisements in question, whether selected or not, be allowed to participate in the fresh selection processby relaxing their age but subject to their having necessary qualifications.
On qualifications the directives mentioned, the qualifications in the case of teachers governed by the provisions of the Right of Children to free and compulsory education Act, 2009 shall be in conformity with the relevant statutory provisions of the said Act. the qualifications of the teachers employed for Class IX and above shall be strictly in compliance with the relevant provisions concerning such appointments.
