Tripura News: HC issues notice to State on assault on CPM MLA case

The High Court of Tripura has issued a notice to the state government following a petition filed by CPM MLA Sudhan Das.

Advocate Sankar Lodh, who moved the petition on behalf of Sudhan Das, said there was a political clash at Rajnagar motorstand on June 27 last following which three cases were registered by Belonia police—one suo moto case, the two others complaints were lodged by MLA Sudhan Das and one local BJP leader.

According to the petitioner, the case against Sudhan Das was registered under sections 341/325/326/307/120B of IPC whereas the case filed by Das was registered under sections all bailable sections—147/149/325 of IPC. The lawyer said that the complaint filed by Das had merits for inclusion of sections like 307/326 of the IPC. The same was sought in the petition.

After going through the submissions of both the petitioner and respondent, the Single Bench of Justice Arindam Lodh ordered for issuing notice to the state government to show cause “as to why a Rule shall not be issued, as prayed for; and/or why such further and other order(s) shall not be passed as to this Court may deem fit and proper.”

As per the order, the case would come for hearing again after 10 days—on July 29 next, the lawyer told the media. (Courtesy: Tripura Times)
